Richard John Nyman, 65, of Wagner was indicted in Charles Mix County Circuit Court Tuesday, October 27, 2009 on four felony drug counts after a search warrant assisted law enforcement in finding drugs and firearms at 400 N. Main NW in Wagner according to court records.
Count 1 a class 2 felony, commission of a felony while armed with a firearm, is a maximum penalty of 25 years in the state penitentiary and $50,000; Count 2 a class 2 felony, commission of a felony while armed with a firearm, is a maximum penalty of 25 years and $50,000; Count 3 a class 3 felony, possession with the intent to distribute one pound or more of marijuana, is a maximum penalty of 15 years and $30,000 fine; Count 4 a class 4 felony, possession of 1-10 pounds of marijuana, is a maximum penalty of 10 years and $20,000 fine; and Count 5 a class 1 misdemeanor, ingesting a substance, except alcoholic beverages, for the purpose of becoming intoxicated, is a maximum of 1 year in the county jail or $2,000 fine or both.
The South Dakota Attorney General's Office has taken over the prosecution of Nyman in this case. He is out of jail on a $2,500 cash bond. Nyman's next court appearance has not been scheduled as of this date.
